a) Acceptance of the tender includes the acceptance of the following terms and conditions.
b) Any departures from the Terms & Conditions can only be made with the written consent of the contractor.
2. Period of Estimate
The estimate remains open for 30 days unless previously withdrawn. Thereafter the estimate is subject to change by the contractor.
3. Basis of the estimate
a) All increases in labour and/or material cost arising after the date of the tender may be recovered from or allowed to the customer unless the tender expressly excludes this condition.
b) The estimate is based upon the work being carried out during normal working hours, Monday to Friday.
c) Variations or additional work shall be charged on time and material basis unless the subject of a separate quotation accepted by the customer.
d) The laying of cables and conduit runs shall be by the shortest practicable routes.
e) Work by other trades, any statutory fees, or charges for work done by supply Authority or local Authority is not included. Unless specifically mentioned in the quotation/estimate.
f) Whilst reasonable care shall be taken, the estimate does not include for incidental redecoration or other work consequent upon the proper execution of the work.
4. Terms of Payment
a) Payment in full shall be due on completion of the work and shall be made within 14 days of the date of a written application/invoice submitted by the contractor.
b) Where the contract period is in excess of 4 weeks, written applications/invoices may be submitted Weekly for the value of work executed - less any previous payments - the net amount due to be paid by the customer within 14 days of completion.
c) Failure by the customer to make any payments as mentioned above shall entitle the contractor to suspend all work and charge interest on the amount outstanding at 5% above the base rate of Barclays Bank PLC from time to time in force.
d) Any goods delivered and /or installed, shall remain the property of Lead Electrical until full payment has been received. The contractor can at any time repossess goods that have been delivered and/or installed if they have not been paid for in due course. Lead electrical shall not be liable for any losses arising from such action.
The contractor shall endeavour to carry out the work within the period stipulated or, if no period is stipulated, within a reasonable time, but shall not be held responsible for any loss or damage arising out of delay due to any cause beyond the contractors control.
6. Consequential loss or damage
Without prejudice to the customers statutory rights, the contractor will pass to the customers the benefit of any guarantees the contractor has received in respect of materials supplied by the contractor and undertakes to repair, or if necessary, replace free of charge any materials, or work, found to be defective, if the fault is due to poor workmanship by the contractor. Is bought to his attention within 12 months of completion of the work and provided that:
a) The contractor accepts no responsibility for any drawing design or specification not prepared by him.
b) The contractor's responsibility to the customer is limited to the fulfilment of the contract in a proper and workmanlike manner and the contractor shall not be liable for any consequential loss or damage arising out of the execution of the contract, unless due to the negligence of the contractor.
c) The contractor shall not be liable for any wear and tear, loss or damage, direct or in direct nor for any extra work entailed due to the apparatus being put into operation by the customer or by the contractor at the customers request before it is handed over for beneficial use.
d) The repair or replacement of any faulty work or materials shall only be carried out by the contractor or one of his agents. Otherwise the contractors warranties as to repair or replacement shall not apply.
e) The contractor shall take reasonable care but accepts no liability for damage to contents, fixtures, and/or fittings which have to be moved by the contractor in order to carry out the contract works. without prejudice to this the contractor will maintain adequate public liability insurance cover during the duration of the contract.
f) The contractor shall not be liable for defects latent or otherwise which may become apparent as a result of the proposed work. This includes damage to water pipes and cables which are not visible or buried in the fabric of the building and not in the prescribed zones set out in BS 7671.
g) The contractor shall not be liable for loss of computer information and/or soft/hardware caused due to loss of power as a result of the proposed works.
h) Where decorative finishes are disturbed and the making good has been included in the estimate/quotation, such making good will be to a reasonable standard, but not decorative finish.
7. Fuse Board replacements
a) A condition report (EICR) is recommended before work is commenced to determine if there are any pre-existing faults to the electrical installation.
b) Any faults that are detected during the EICR will be charged as in item 3c and will be an additional cost to the estimate /quotation given for the replacement of the fuse board.
Without prejudice to the above terms, the customer may have the benefit of the performance guarantee schemes of the NIC EIC & CheckaTrade (of which the contractor is a member) subject to the terms of such a scheme.
